Welcome to The INKwell Club Cruise and Concerts (“we,” “us,” “our,” or “INKwell”). These Terms and Conditions (“Terms”) govern your use of our website (theinkwellnyc.com) and the purchase of tickets, packages, or any other products or services offered by us.

By accessing our website, purchasing tickets, or attending any event, you agree to be bound by these Terms. If you do not agree, do not use our website or purchase tickets.

1. Ticket Purchases and Sales

All ticket sales, event packages, bottle service, table reservations, and any other purchases made through our website or authorized partners are final.

All sales are final.
All ticket purchases are non-refundable.

This includes (but is not limited to):

  • Single tickets
  • Group tickets
  • VIP packages
  • Table and bottle service reservations
  • Cruise or special event tickets
  • Any add-ons or upgrades

No refunds, exchanges, or credits will be issued for any reason, including but not limited to:

  • Change of plans
  • Inability to attend
  • Weather
  • Travel issues
  • Personal emergencies
  • Dissatisfaction with the event
  • Changes to artists, performers, or lineup

2. Event Changes, Cancellations, and Postponements

All artists, performers, DJs, and events are subject to change without prior notice.

We reserve the right to cancel, postpone, reschedule, or change the lineup, venue, date, time, performers, or any other aspect of an event at our sole discretion.

In the event of a cancellation by The INKwell Club Cruise and Concerts, we may (at our sole discretion) offer a credit toward a future event or a refund. This is the only exception to the non-refundable policy and is not guaranteed.

3. Force Majeure

The INKwell Club Cruise and Concerts shall not be liable or responsible for any failure or delay in performing its obligations under these Terms (including the staging of any event) if such failure or delay results from circumstances beyond our reasonable control. These circumstances include, but are not limited to:

  • Acts of God, natural disasters, extreme weather, fire, flood, earthquake, or severe storms
  • Pandemic, epidemic, public health emergency, or government-mandated shutdowns
  • War, terrorism, civil unrest, strikes, labor disputes, or acts of government
  • Power outages, transportation disruptions, or technical failures
  • Any other event or circumstance beyond our reasonable control

In the event of a force majeure occurrence that causes an event to be cancelled, postponed, or significantly altered, no refunds will be issued. At our sole discretion, we may offer ticket holders a credit toward a future event or the opportunity to transfer their ticket to a rescheduled date. This does not create any obligation to provide a refund or credit.

4. Chargebacks and Payment Disputes

By completing a purchase, you expressly agree to the following:

  • You acknowledge that all sales are final and all ticket purchases are non-refundable.
  • You agree not to initiate a chargeback, payment dispute, or claim of unauthorized transaction with your bank or credit card company for any reason related to the purchase.
  • Initiating a chargeback or payment dispute after receiving the tickets or confirmation of purchase constitutes a material breach of these Terms.
  • In the event you initiate a chargeback or payment dispute, you agree to reimburse The INKwell Club Cruise and Concerts for the full amount of the chargeback, plus any associated bank fees, chargeback fees, collection costs, and reasonable attorney’s fees.
  • We reserve the right to pursue all available legal remedies, including collections and legal action, to recover amounts related to improper chargebacks.
  • Ticket confirmation emails, digital tickets, and purchase records serve as proof of delivery of the product/service.

We strongly encourage customers to contact us directly with any concerns before initiating a chargeback.

5. Checkout Acknowledgment 

Before completing any purchase, you acknowledge and agree to these Terms.

I acknowledge and agree to the following:
• All sales are final and all ticket purchases are non-refundable
• All artists, performers, and events are subject to change without notice
• I will not file a chargeback or payment dispute with my bank or credit card company
• I have read and agree to the complete Terms and Conditions

By completing your purchase, you confirm that you have read, understood, and agreed to these Terms in full.

6. Age Restrictions and Entry Requirements

Most events at The INKwell Club Cruise and Concerts are 21+ only unless otherwise stated. Valid government-issued photo ID is required for entry. We reserve the right to refuse entry to anyone who does not meet age, dress code, or conduct requirements. No refunds will be issued for refused entry.

7. Code of Conduct

Guests must behave respectfully. We reserve the right to remove any guest for disruptive, unsafe, or inappropriate behavior without refund.

8. Limitation of Liability

To the fullest extent permitted by law, The INKwell Club Cruise and Concerts and its owners, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising from your purchase or attendance at any event.

9. Intellectual Property

All content on this website, including logos, text, images, and branding, is the property of The INKwell Club Cruise and Concerts and may not be used without written permission.

10. Privacy

Your use of our website is also governed by our Privacy Policy. Any marketing or promotional communications require separate consent in accordance with applicable privacy laws, including GDPR where applicable.

11. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of New York County, New York.

12. Changes to These Terms
